After the Administrative Judge (AJ) makes their decision, if not favorable, a Federal Employee may Petition the Board for Review of the AJís decision. If the Agency losses, they also have a right to Petition the Board for Review. Generally, a Petition must be filed within 35 days of the date of the decision or 30 days of receipt of the decision, whichever is later.

The Federal Employee has another option if the AJ renders an unfavorable decision other than filing a Petition. A Federal Employee may instead request judicial review in the US Court of Appeals for the Federal Circuit in Washington D.C. or, in a mixed case complaint, may seek judicial review with the US District Court. Jonathan Bell is qualified to represent you in any stage of litigation.

Disciplinary Actions

Jonathan Bell can represent you at any stage of a disciplinary action starting from the investigative stages (including assisting in responding to a Proposed Action such as termination or suspension as well as representing you in front of a Deciding Official in making your oral reply to any proposal) to the Merit Systems Protection Board and even to the US Court of Appeals for the Federal Circuit in Washington D.C.
